Probate/Estates

When the court system gets involved to distribute someone’s assets after his or her death, the process is called “probate”. In probate, the Clerk of Court will verify the will and evaluate its provisions to ensure they comply with current North Carolina law. The clerk will then apply a detailed list of statutes to determine who gets what.

The clerk will appoint someone to act as the executor of the estate (or testator if there was no will). Once that appointment has been made, the executor must follow very specific laws to ensure that he or she is handling the estate properly. Those laws require, for example, that accountings be filed with the court, that creditors be notified, etc. The process can be daunting, especially while you’re dealing with the grief of your loss, but we’re here to help.
